New Delhi: Jamia Millia Islamia University student Asif Iqbal Tanhak, who was arrested under the UAPA in the North East Delhi riots case, has been allowed to move to a guest house to appear for the exams. The Delhi High Court on Thursday allowed him to move to a guest house to appear for the exams on December 4, 5 and 7.
A bench of Justice Manoj Kumar Ohri allowed Tanha to move to a guest house in Lajpat Nagar while considering the interim bail application filed for the examination. The bench also directed the authorities to allow all necessary reading materials and books to be carried.
It is the responsibility of the jail superintendent to take Tanha from the guest house to the examination center at JMI University at 8.30 am. The court also said that he should be brought back to the guesthouse after the examination. They should be brought back to jail after the exams. While staying at the guest house, Tanha was also allowed to make phone calls with her lawyer for 10 minutes once a day.
The trial court had on November 26 granted Tanha custody custody. Tanha later approached the court seeking interim bail through his lawyer. Custody parole was wasted all day, they could not study and demanded interim bail.
Additional Solicitor General SV Raju, appearing for the Delhi Police, opposed the interim bail application and said that the accused could study in jail and there was no complaint. Raju also argued in court that many prisoners are studying in jail. It was Raju who suggested that he stay in a guest house for the examination. That was accepted by the court.
Earlier, Tanha was granted three days’ parole to appear for a court hearing. Tanha, who was arrested on May 19, has been in judicial custody since then. M.A. Tanha was granted a one-day parole on October 21 to write the entrance exam for the Persian course.
